It is a common misconception that the constitutional right to freedom of expression entitles people to express their opinions on social media without censure and notwithstanding that their statements may be offensive defamatory or otherwise wrongful. This presentation covers the rights and obligations of persons when publishing statements and opinions on social media. It also discusses the rights and obligations of employers to discipline or dismiss employees whose commentary on social media even if published after hours using an employee’s own electronic devices impact the employment relationship.
This presentation also addresses key legislation relevant to the topic and presents a strategy to employers for dealing with social media threats.
